The Glyndebourne Opera Cup 2020 applicant’s release form

The releases and undertakings given by you in this Release Form are given by you in favour of all and/or any of Glyndebourne, Sky Arts and Factory Films Limited (“the Companies”, “we” and/or “us”).

By submitting a Glyndebourne Opera Cup Application Form, you agree to grant the rights and give the undertakings contained in this Release Form.
Factory Films Limited are undertaking filming for the purposes of producing “The Glyndebourne Opera Cup” for Sky Arts (“the Programme”). The Glyndebourne Opera Cup is a Live Broadcast of the Glyndebourne Opera Competition for Sky Arts covering the Final in March 2020. Materials produced in the process of that filming may be used through other media, including radio and online content.

In consideration of our arranging to film you and record any interview and/or contribution and/or performance (together, “Contribution”) to be given by you to us on the filming date or dates mutually agreed in advance, you agree to the recording and filming of the Contribution. This is a condition of entry into the Competition.

You acknowledge that you have had explained to you and you fully understand the full nature of the Programme and your participation in it and you agree so to participate. You warrant and undertake that (i) you are fully entitled to grant all rights and consents herein; (ii) your contribution will be honest and true; (iii) nothing in your Contribution will infringe any copyright or data protection laws or any other right of any person, breach any contract or duty of confidence, constitute a contempt of court, be defamatory, and/or otherwise bring the Companies (or any of them) or any other party into disrepute; and (v) you will advise us of any information which might compromise or call into question the integrity of the Programme and/or might impact the reputation of the Companies (or any of them).

You hereby assign to us all rights in and to your Contribution and give all consents necessary for the reproduction, exhibition, transmission, broadcast, publicising, previewing, reviewing and exploitation of the Contribution (together with any materials of whatever sort submitted by you in connection with your application to enter the Competition) without time limit throughout the universe by all means and media (whether now known or hereafter invented) without liability or acknowledgement to you. You hereby grant to us the right to and authorise others to issue publicity concerning your services in connection with the Programme and the Competition and to use your name, voice, biography, photographs, videos and likeness in connection with the exploitation, advertising, publicising and/or promotion of the Programme.

We shall be entitled to cut, edit and translate the Contribution as we deem fit and we shall not be obliged to include all or any of the Contribution in the Programme and you irrevocably and unconditionally waive any so called “moral rights” you may have in your Contribution. You shall keep confidential and shall not disclose to any third party, any information, photographs or other material relating to the Contribution, the Companies, the Programme or anyone taking part in it unless otherwise agreed by us in writing.

The benefit of this Release Form shall be freely assignable by us and is governed by the laws of England and Wales and the exclusive jurisdiction of the English and Welsh courts applies.
